California Debt

I stop paying my credit card in July 2004 when I just received a summons to a person stating that I have a court date. No hearing date is of the form, but it shows that it was filed on July 7. I wonder if the debt
collection company has filed before the limitations exhausted.

Richard is correct, the SOL in CA can not be reset by payments after the account was charged off. Below is a link to the text of the law.

If I read the law correctly, the "last" would be a charge or payment before the account is closed and charged off.

You must request a full report on this account so that you can tell exactly when the last charge or payment has been made. If they are unable or unwilling to provide the account, push to have the case dismissed on the grounds that the SOL has probably expired.

Most states require it to spend at least seven years to be removed from a credit report.
However, in recent years the claimant has chosen to sell bad loans to third in which he buys at a discount.
Please note however that the results of any type of payment to these parties in acceptance.If you do not pay, and they are indeed a third party, you can not be forced to make payments on debt.
But if a debt is valid, then they can place liens against the real or personal property to satisfy those debts.
Also, if it is a circumstance for you as an option to declare bankruptcy, you can do, but it can cost $ 500.00 + to so.At no time, however, they could jail for failure to pay a debt, if not fraud.

Credit Card SOL in California is four years after the last activity.

"Activity" is the last time you made a payment, nor the last time you used the card, or other written communication from you on the map.

Sounds like they did, in fact, the file under the wire to tighten.
